By accessing or using the Powersource Solutions website (the "Website") and its associated services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree with any portion of these Terms, you must immediately cease use of the Website and Services. We may revise these Terms at any time, and continued use after changes constitutes your acceptance.

1. Purpose of Website and Services

Our Website and Services are provided as a convenience to help you identify third-party licensed installers ("Installers") who have demonstrated certain qualifications for installing electrification products. While we may facilitate contact and quotes from Installers, the ultimate responsibility for evaluating and selecting an Installer remains solely with you.

2. Installer Qualifications and Services

Powersource Solutions is committed to:

Code Compliance: All certified Installers must meet the standards and requirements of the local Authority Having Jurisdiction (AHJ), including obtaining necessary permits and inspections.
Quality Materials: Installers must use premium parts and materials complying with manufacturer specifications and relevant electrical codes.
Financial Incentives: Informing you of applicable rebates or financial incentives to reduce installation costs.
Customer Support: Providing timely responses (within one business day) to any inquiries regarding your installation.
Warranty: Installers provide a minimum 12-month warranty on electrical parts and labor. If an Installer does not honor their warranty within ten (10) business days, we will assist in identifying an alternative Installer.

3. Relationship with Installers

Powersource Solutions is not a licensed contractor or general contractor. We do not perform installations, nor do we directly oversee Installers. Your interactions, agreements, and contracts with Installers are solely between you and the selected Installer. You agree that any dispute or dissatisfaction regarding Installer performance must be resolved directly with the Installer.

4. Refund Policy and Product Sales

If you purchase products directly through Powersource Solutions, you may request a refund or exchange within 30 days of purchase, provided the products are returned unused, in original packaging, and with proof of purchase. Refunds will be issued to the original payment method used. Please note, installation services are not refundable once services are completed unless covered by warranty or installation failure as outlined elsewhere in these Terms.

5. Disclaimers and Limits of Liability

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE AND SERVICES IS AT YOUR OWN RISK. POWERSOURCE SOLUTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FROM DELAYS, INSTALLATION FAILURES, INJURY, PROPERTY DAMAGE, OR ANY ACTIONS OF INSTALLERS OR THIRD PARTIES.

You are granted a limited, non-exclusive, non-transferable license to access and use the Website and Services solely for your personal or internal business use. You must provide accurate, current, and complete information when utilizing our Services and must not duplicate, reproduce, or distribute Website content without explicit permission.

7. User-Provided Content

When submitting information or content (excluding personal data governed by our Privacy Notice), you grant Powersource Solutions a non-exclusive, worldwide, perpetual, royalty-free license to use, modify, adapt, publicly display, and distribute such content. You warrant that you have all rights necessary to submit such content and that all submitted reviews and ratings are truthful and accurate.

By using the Website, you agree not to:

You consent to receive communications from us electronically via email or through your account. Such communications meet any legal requirement for written notice.

16. Governing Law and Arbitration

These Terms and any disputes related to your use of the Website or Services will be governed by the laws of the State of New Jersey. Any disputes must be resolved through mandatory binding arbitration conducted by a single arbitrator, according to AAA rules. Arbitration proceedings will be held in Bergen County, New Jersey, or the closest AAA location.

17. Class Action Waiver

You agree that any claims will be brought individually and not as part of a class or collective action. Class arbitration or consolidation of claims is expressly prohibited.

18. Miscellaneous

These Terms constitute the entire agreement regarding your use of the Website and Services and supersede all prior agreements. Our failure to enforce any provision shall not constitute a waiver of that provision. These Terms are assignable by Powersource Solutions without your consent.
